CLARIFICATION TEXT ON THE LAW ON THE PROTECTION OF PERSONAL DATA (KVKK)

As Opticsunn ("Company"), we attach importance to the security and confidentiality of personal data processed through the "kargo-takip" (cargo-tracking) application ("Application") that we offer via the Shopify App Store. This Clarification Text has been prepared in accordance with Article 10 of the Law on the Protection of Personal Data ("Law") numbered 6698, to inform sellers (merchants) and their end-users (customers) about the personal data collected, processed, and transferred by our Company, acting as the data controller, during the use of the Application.

1. Your Processed Personal Data and Methods of Acquisition

As soon as the Application is integrated into your Shopify store, it accesses and processes the following personal data through the Shopify API infrastructure using fully automated methods:

  • Seller (Customer) Information: Store owner's name-surname, store name, e-mail address, billing and store address information.

  • Order and Delivery Information: Order number, order content, package weight, package size, and real-time order status.

  • Recipient (Customer) Contact and Delivery Information: Name-surname of the recipient to whom the product will be delivered, delivery address, phone number, and e-mail address.

2. Purposes and Legal Grounds for Processing Personal Data

Your collected personal data is processed for the following purposes within the personal data processing conditions specified in Articles 5 and 6 of the Law:

Execution of logistics processes for orders, delivery of cargo to the correct address, optimization of courier routes, and sending real-time delivery status notifications to the recipient via SMS/WhatsApp/E-mail.

The processing of personal data belonging to the parties of a contract is necessary, provided that it is directly related to the establishment or performance of a contract.

Order and Status Details

Live synchronization of cargo movements (Preparing, In Delivery, Delivered, etc.) for orders created on the site and listing them on both seller and customer panels.

The data controller's ability to fulfill its legal obligation and legitimate interests, provided that it does not harm the fundamental rights and freedoms of the data subject.

Seller / Store Information

Completion of application installation, management of membership processes, execution of billing operations, and provision of technical support.

Establishment and performance of the contract, the data controller's legal obligation.


3. To Whom and for What Purpose Processed Personal Data May Be Transferred

Your personal data is not sold to third parties or shared for advertising/marketing purposes. However, for the uninterrupted completion of cargo and logistics processes, it is only transferred to the following parties:

  • Logistics and Cargo Providers: The recipient's name, surname, address, and telephone information are securely transferred via API integration to integrated cargo companies or the Company's contracted courier network for the purpose of physical delivery.

  • Authorized Public Institutions and Organizations: In case of legal disputes or when required by legislation, it may be transferred to judicial authorities or relevant law enforcement agencies within the framework of legal obligations.

4. Retention Period and Security of Personal Data

Your personal data is stored for the period necessary for the completion of cargo tracking processes and for the application to provide services, or until the seller removes the Application from the Shopify store. When the Application is uninstalled, the relevant store and order data are permanently deleted from our systems in accordance with Shopify rules and platform policies. All data is protected by encryption with international security protocols such as SSL/TLS.

5. Rights of the Data Subject Under Article 11 of the Law

As personal data owners, you have the following rights under Article 11 of the Law:

  • To learn whether your personal data is processed,

  • To request information if your personal data has been processed,

  • To learn the purpose of processing your personal data and whether they are used in accordance with their purpose,

  • To know the third parties to whom personal data are transferred domestically or abroad,

  • To request the rectification of personal data if it is incomplete or incorrectly processed,

  • To request the erasure or destruction of personal data if the reasons requiring its processing cease to exist, despite being processed in accordance with the Law and other relevant legal provisions.

You can submit your requests regarding these rights through the seller or directly to the Opticsunn management team. Your requests will be concluded free of charge within a maximum of 30 days.
